- INTELLECTUAL PROPERTY
Unless otherwise indicated, the Web site and its original content, including text, graphics, logos, photographs, videos, audio recordings, designs, documents, downloadable materials, and other content created or commissioned by Hagiggah.org, are owned by Hagiggah.org or used with permission and/or are protected by applicable intellectual-property laws.

Except as permitted by law or expressly authorized by Hagiggah.org, Web site content may not be reproduced, distributed, modified, republished, publicly displayed, sold, licensed, or commercially exploited without prior written permission.
- THIRD-PARTY MATERIALS
Some photographs, artwork, music, videos, articles, trademarks, logos, or other materials appearing on the Web site may be owned by third parties and used by Hagiggah.org pursuant to permission or license or fair use or other applicable legal authority.
Nothing in these Terms grants users any rights to third-party intellectual property.
- USER-SUBMITTED CONTENT
The Web site may permit users to submit information, applications, comments, photographs, testimonials, stories, artwork, documents, or other materials.
You retain any ownership rights you otherwise possess in material you submit.
By voluntarily submitting material for publication or promotional use by Hagiggah.org, you grant Hagiggah.org a nonexclusive, royalty-free license to use, reproduce, display, distribute, and communicate that material for the purposes for which it was submitted, subject to applicable law and any specific consent, release, or agreement governing the submission.
Submission of an application, confidential document, grant request, scholarship application, donor information, or other material that is not intended for publication does not, merely by submission, authorize Hagiggah.org to publish that material.
You represent that you have the right to submit material you provide and that its authorized use by Hagiggah.org will not knowingly violate another person's rights.
- PHOTOGRAPHS, VIDEO, MUSIC, ARTWORK, AND YOUTH CONTENT
Because Hagiggah.org supports arts and youth-development activities, the Web site may include photographs, artwork, performances, music, video, testimonials, or other creative material involving program participants.
Hagiggah.org will seek, where possible, appropriate permissions, licenses, releases, or authorizations when required before intentionally publishing identifiable material involving participants.
Where a minor is known to be involved, Hagiggah.org will obtain parental or legal-guardian authorization when required by applicable law or organizational policy.
Web site visitors may not download, reproduce, republish, manipulate, or use identifiable images or recordings of minors from the Web site for commercial, exploitative, misleading, or inappropriate purposes.
- CHILDREN AND MINORS
Hagiggah.org recognizes that its charitable mission benefits young people.
The organization’s Web site is intended primarily for parents, guardians, donors, educators, arts professionals, nonprofit organizations, community partners, and other adults.
Children under 13 should not submit personal information through the general Web site without the involvement and authorization of a parent or legal guardian.
Where Hagiggah.org knowingly operates an online activity subject to the Federal Children's Online Privacy Protection Act ("COPPA"), we will follow applicable parental notice, consent, data-use, security, retention, and deletion requirements.
Additional requirements may apply to grant, scholarship, program, or other applications involving minors.
- GRANT AND SCHOLARSHIP INFORMATION
The Web site may provide information concerning grants, scholarships, funding opportunities, eligibility requirements, application procedures, deadlines, and selection processes.
Publication of an opportunity does not guarantee that any applicant will receive funding.
Submitting an application does not create a contractual relationship or entitlement to a grant, scholarship, award, or other benefit.
Hagiggah.org reserves the right, consistent with applicable law and any published program requirements, to:
● Establish and modify eligibility requirements;
● Request additional information;
● Verify information contained in an application;
● Determine whether an application is complete;
● Establish application and review deadlines;
● Select recipients;
● Determine award amounts;
● Decline applications; and
● Modify, postpone, suspend, or discontinue a grant or scholarship program.
Decisions will be made in accordance with Hagiggah.org's applicable policies, charitable purposes, and governing requirements.
- DONATIONS
The Web site may permit users to make charitable contributions to Hagiggah.org.
Donations are subject to applicable Federal and California law and Hagiggah.org's charitable purposes.
Unless expressly stated otherwise at the time of the donation, contributions are made to Hagiggah.org for use in furtherance of its charitable mission.
Hagiggah.org will provide donation acknowledgments or receipts when appropriate or required.
The deductibility of a charitable contribution depends upon the donor's individual circumstances and applicable tax law. While information provided by Hagiggah.org regarding charitable contributions is not tax or legal advice, Hagiggah.org has been confirmed as a public charity and according to the U.S. Internal Revenue Service, “Donors can deduct contributions they make to you under IRC Section 170" for Federal income tax purposes.
Donors should be sure to consult their own tax adviser regarding the deductibility or tax treatment of a contribution.
- RESTRICTED OR DESIGNATED DONATIONS
Hagiggah.org may provide donors with opportunities to express a preference that a contribution support a particular program, project, scholarship, initiative, or charitable purpose.
Where Hagiggah.org expressly accepts a contribution subject to a legally binding restriction, Hagiggah.org will administer the contribution consistent with that restriction and applicable law.
Where a donor merely expresses a nonbinding preference or designation, Hagiggah.org will make reasonable efforts to honor the donor's preference while retaining the discretion necessary to use charitable funds in furtherance of its exempt purposes and applicable organizational policies.
If a designated program or purpose becomes impossible, impracticable, unnecessary, or inconsistent with Hagiggah.org's charitable purposes or legal obligations, Hagiggah.org will address the funds in accordance with applicable law and any governing gift agreement.
- PAYMENT PROCESSING
Online donations and other payments may be processed by an independent third-party payment processor.
Hagiggah.org does not intend to directly store complete credit-card or debit-card information on its own Web site servers.
Use of a third-party payment service may also be governed by that provider's terms and privacy practices.
- RECURRING DONATIONS
If Hagiggah.org offers recurring donations, the frequency and amount of the recurring contribution will be disclosed before the donor authorizes the transaction.
A donor may request cancellation of future recurring contributions through the cancellation method identified when the recurring donation is established or by contacting Hagiggah.org.
Cancellation of future recurring donations does not ordinarily reverse contributions already processed, except where required by law or expressly agreed by Hagiggah.org.
- REFUNDS OF CHARITABLE CONTRIBUTIONS
Charitable contributions are generally considered final once processed.
Hagiggah.org may, however, consider requests involving duplicate transactions, processing errors, unauthorized transactions, or other exceptional circumstances.
Nothing in this section limits any rights that a donor may have under applicable law or payment-card rules.
- E-MAIL AND ELECTRONIC COMMUNICATIONS
By voluntarily providing an e-mail address or other electronic contact information, you may receive communications relating to your donation, application, inquiry, program participation, or other interaction with Hagiggah.org.
If you separately subscribe to newsletters, fundraising communications, or promotional communications, you may unsubscribe using the method provided in those communications.
Unsubscribing from promotional communications does not prevent Hagiggah.org from sending transactional, administrative, legal, donation-related, grant-related, scholarship-related, or other non-promotional communications when appropriate.

The Web site may contain links to third-party Web sites and services.
Links are provided for convenience or informational purposes and do not necessarily constitute an endorsement, sponsorship, or recommendation by Hagiggah.org.

To the extent permitted by law, users who intentionally or unlawfully misuse the Web site agree to indemnify and hold harmless Hagiggah.org and its directors, officers, employees, volunteers, and agents from third-party claims, damages, liabilities, and reasonable expenses arising directly from that unlawful misuse or violation of these Terms.

- ENTIRE AGREEMENT
These Terms, together with the Hagiggah.org Online Privacy Policy, Cookie Policy (where and if applicable), and any additional terms specifically applicable to a particular program, application, donation, or service, constitute the applicable terms governing use of the Web site.
